Terms of Use (EULA) for BPM Collect

Introduction
This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you ("User" or "you") and Objktt Studio ("we," "our," or "us") for the use of BPM Collect mobile application ("App").
By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement.

📱 Subscription Terms for Auto-Renewable Plans (Monthly & Yearly)
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
- Account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel your subscriptions by going to your App Store account settings after purchase
- Any unused portion of a free trial period will be forfeited when purchasing a premium subscription

- Includes all future updates and premium feature additions

- Purchase is final and non-refundable after 14 days per Apple's policy
License Grant
Subject to the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your compatible devices solely for your personal, non-commercial use.
Permitted Uses
- Measure BPM (beats per minute) of audio tracks
- Store and organize BPM measurements in your personal library
- Search for vinyl record information via Discogs integration
- Sync data across your devices (with user account)
- Use premium features with active subscription
Restrictions
You agree NOT to:
- Modify, adapt, alter, translate, or create derivative works of the App
- Reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code
- Remove, alter, or obscure any proprietary notices on the App
- Use the App for any illegal or unauthorized purpose
- Share your premium subscription with others
- Circumvent usage limits or premium features without subscription

Free Tier
- Limited to 10 BPM measurements per day

Premium Subscription
- Unlimited BPM measurements

Billing and Cancellation
Auto-Renewable Subscriptions (Monthly & Yearly)
- Monthly Plan: Billed at $0.99 every month
- Yearly Plan: Billed at $7.99 every year (33% savings)
- Payment is charged through your Apple ID account
- Automatic renewal unless cancelled 24+ hours before period end
- Manage subscriptions in App Store account settings
- No refunds for partial subscription periods
- Access to premium features ends when subscription expires or is cancelled
Lifetime Purchase
- One-time payment: $19.99 (no recurring charges)
- Permanent access to all premium features

Intellectual Property
- The App and its content are owned by Objktt Studio and protected by copyright and other intellectual property laws
- Discogs metadata is provided under license from Discogs LLC
- You retain ownership of your personal BPM measurements and data
- You grant us a license to store and sync your data to provide the service
- All trademarks, service marks, and logos are proprietary to their respective owners
Privacy and Data
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.
Third-Party Services
The App integrates with third-party services including:
- Discogs API for vinyl record metadata
- Google/Apple for authentication services
- Google AdMob for advertisements (free users)
- Supabase for secure data storage and sync
Your use of these services is subject to their respective terms and policies.
Disclaimers
- The App is provided "AS IS" without warranties of any kind, express or implied
- BPM measurements are estimates and may vary in accuracy
- We do not guarantee uninterrupted or error-free operation
- Third-party data may be incomplete, inaccurate, or unavailable
- We are not liable for any data loss, corruption, or service interruptions
Limitation of Liability
To the maximum extent permitted by applicable law, Objktt Studio and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from your use of the App.
Termination
- You may terminate this Agreement by deleting the App from your device
- We may terminate or suspend your access for violations of these Terms
- Upon termination, your right to use the App ceases immediately
- Provisions regarding intellectual property, disclaimers, and liability survive termination
- Active subscriptions continue until the end of their billing period
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the updated Terms.
Governing Law
This Agreement is governed by and construed in accordance with the laws of the jurisdiction where Objktt Studio is located, without regard to conflict of law principles. Any disputes arising under this Agreement shall be resolved in the appropriate courts of that jurisdiction.
Apple App Store Additional Terms
If you downloaded the App from the Apple App Store, the following additional terms apply:
- This Agreement is between you and Objktt Studio, not Apple Inc.
- Apple is not responsible for the App or its content
- Apple has no obligation to provide maintenance or support for the App
- If the App fails to conform to any warranty, you may notify Apple for a refund
- Apple is not liable for any claims relating to the App
- Apple is a third-party beneficiary of this Agreement
